In order to use all features or portions of PR Track website, you may be required to connect to your fitness devices and platforms, including, but not limited to, Strava, Garmin watches and Apple watches, including providing a username, e-mail, password or other information required when you access that devices and platforms through PR Track website. You are responsible for maintaining the confidentiality of all your devices and platforms information and for all the related activity associated with your PR Track account.

You assume that all the information you provide is correct, current and complete, and it is governed by our Privacy Policy.

You also acknowledge that your PR Track account is personal to you and agree not to provide any other person with access to this PR Track website or portions of it using your user name, password or other security information. We are not responsible for any loss or damage caused by your failure to take reasonable security measures or disclosure of your username and password. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security.

PR Track has the right to disable any user name, password or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Service.

PR Track hereby grants you a non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the PR Track website and services solely for searching for an event on the PR Track website, accessing or claiming events results, using any functionality in your PR Track account, or using the PR Track website to but not limited to promote an event as an Event Director.

You shall not reproduce, modify, display, publicly perform, distribute or create derivative works of or circumvent any access controls to the PR Track website, for any purpose not specifically permitted herein. You represent that your use of the PR Track website complies and will continue to comply, with all applicable foreign, federal and state laws, rules and regulations.

If you are an Event Director and collect information from a user facilitated through the PR Track website, you must provide a link to an applicable privacy policy that discloses your collection, use and storage practices, including any disclosure to any third party and such policy must comply with all applicable data privacy laws and regulations.

You hereby grant PR Track a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use your image uploaded by Event Directors or through the PR Track website. If you are an Event Director or acting on behalf of an Event Director and you upload any Athlete Images and Data, you hereby grant PR Track a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use the Athlete Images and Data on the PR Track website.

Not all materials are reviewed before posted on the PR Track website, and we cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any accuracy, action or inaction regarding transmissions, communications or content provided by any user or third party. We have no liability or responsibility to anyone for performance or non-performance of the activities described in this Terms of Use.

PR Track does not allow users or any other person visiting PR Track website to use any robot, spider or other automatic device, process or means to access the PR Track website for any purpose, including monitoring or copying any of the material on the PR Track website; to use any manual process to monitor or copy any of the material on the PR Track Sites or for any other unauthorized purpose without our prior written consent;

User Contributions must not contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, or that promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

Also, users contributions must not infringe any trademark, trade secret, copyright or other intellectual property or other rights of any other person; Violate the legal rights of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Service and our Privacy Policy;

User Contributions must not promote any illegal activity, or advocate, promote or assist any unlawful act; users are not allowed to cause annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person;

Users are strictly prohibited to involve commercial activities or sales in their Users contributions, such as, but not limited to, contests, sweepstakes and other sales promotions or advertising; or give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

You represent and warrant that you own or control all rights in and to the User Contributions and have the right to grant the license granted above to us and our affiliates and service providers, and each of their respective licensees, successors and assigns. All of your User Contributions do and will comply with these Terms of Use.

PR Track has the right to remove or refuse to post any User Contributions for any or no reason in our sole discretion; including if we believe that such User Contribution violates the Terms of Use, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the PR Track website or the public or could create liability for PR Track;

PR Track can also disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy; we can also take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the PR Track website;

If there is any violation of these Terms of Service, PR Track has the right to terminate or suspend your access to all or part of the PR Track website.

About the PR Number

When you create an account on the PR Track website and start to provide your personal information such as, but not limited to, your connected devices data, your participation in events and GPS data; your personal PR number will be displayed on your PR Track account and your PR Track public profile, among others. Our proprietary algorithm processes this data to generate an estimated final number (the PR number) that best aligns with your sports rating.

PR Track consistently enhances and validates this proprietary algorithm to ensure the highest accuracy, utilizing machine learning to identify patterns that better mirror reality.

The PR number is automatically generated by a computerized algorithm and cannot be altered manually. We are able to add or edit incorrect or missing information on your records, which may impact your rating. You agree that PR Track does not need to give you any further right to preview, approve, change or modify the process that is used to generate the PR Number.

While we strive for precision, there may be instances where the generated number differs from your expectations. However, we welcome and encourage your feedback, which our team will analyze to address any discrepancies. If you believe your PR number does not accurately reflect your performance, please share your feedback.

You understand and acknowledge that PR Track is not liable for any discrepancies or misinterpretations that may arise from the PR number. This number is intended for personal reference only.

PR Track has the right to disable any user account at any time in our sole discretion if we may find incorrect, false or inaccurate information regarding your personal data such as, but not limited to, your GPS/devices data, that intend to be used to modify or manipulate your PR number and/or your results. This action should be considered a violation of these Terms of Service.

PR Track reserves the right to use, share and display yours and all other users PR Numbers in any manner in connection with the business of PR Track without attribution to you or your previous approval.

About the Use of PR Track Name and Brand

PR Track holds and owns the copyright and all other proprietary and intellectual property rights and title in and to the collective work, including but not limited to the pages, graphics, design, texts, images, materials and content of the PR Track website. You agree that you will not copy, reproduce, alter, modify, reverse engineer, distribute, transfer, sell, transmit, translate, publish, perform or license any of the contents of the PR Track website, including any information, products and / or services, without PR Track express written consent. Subject to these and any other express restrictions with regard to specific material, you understand that you may download information concerning your PR Track Account, event or other information as allowed by PR Track applicable to the use of the PR Track website.

The PR Track name, logos, products and services names, designs and slogans are trademarks of PR Track or its affiliates or licensors. You must not use them without the prior written permission of PR Track.
